Overview

The at-fault driver had been traveling the wrong way on a two-lane road, realized his error, and executed a U-turn onto an adjacent road before pulling back out without maintaining a proper lookout, placing himself directly in the path of oncoming traffic. The defense argued that the collision would not have occurred if the vehicle carrying the client had been traveling within the posted speed limit.

Co-counsel successfully argued that the accident would never have occurred if the other driver had not made an illegal maneuver and failed to yield. The defense ultimately agreed to pay the full amount of their available policy limits.

The client, who had accumulated over $1 million in medical expenses, has since recovered and gone on to live a full life, which made this case particularly meaningful.
