DUI Defense & Not Guilty Verdict

Scott Cummins secured a full acquittal at jury trial for a 50-year-old man charged with DUI based on the presence of marijuana in his blood following a one-car accident. The State’s case rested on GBI expert testimony linking the marijuana to impairment.

Scott retained an independent expert witness who told a different story — that the marijuana detected was a metabolite of prior use, reportedly for cancer treatment, and was not present at a level sufficient to impair the client’s driving at the time of the accident.

The jury agreed. For a man facing a DUI conviction rooted in medication rather than impairment, the acquittal was the only just outcome.
